1. Agreement to Terms

By accessing or using the Consystence platform and website ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not access or use our Services.

2. Description of Services

Consystence provides an AI-native industrial IoT platform for real-time monitoring and control of mining and industrial operations. Our Services include the Consystence platform, edge device software, APIs, documentation, and related support.

3. Account Registration

To access certain features, you must register for an account. You agree to provide accurate, current, and complete information and to keep your account credentials secure. You are responsible for all activity under your account.

4. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose
  • Attempt to gain unauthorised access to any part of the Services
  • Interfere with or disrupt the integrity or performance of the Services
  • Reverse engineer, decompile, or disassemble any part of the Services
  • Use the Services to process data for which you do not have the necessary rights

5. Intellectual Property

The Services, including all software, content, and documentation, are owned by Consystence Pty Ltd and protected by intellectual property laws. Your use of the Services does not grant you ownership of any intellectual property rights in the Services.

6. Customer Data

You retain all rights to data you submit to the platform ("Customer Data"). You grant Consystence a limited licence to process Customer Data solely to provide the Services. We will handle Customer Data in accordance with our Privacy Policy.

7. Service Level and Availability

We strive to maintain high availability of our Services. Specific service level agreements (SLAs) may be included in your subscription agreement. We reserve the right to perform scheduled maintenance with reasonable notice.

8. Limitation of Liability

To the maximum extent permitted by law, Consystence shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly. Our total liability shall not exceed the amount paid by you in the twelve months preceding the event giving rise to the claim.

9. Indemnification

You agree to indemnify and hold harmless Consystence from any claims, damages, or expenses arising from your use of the Services or your violation of these Terms.

10. Termination

Either party may terminate these Terms upon written notice. Upon termination, your right to access the Services will cease. We will provide a reasonable period for you to export your Customer Data.

11. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Queensland.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website. Your continued use of the Services after changes constitutes acceptance of the revised Terms.
